This Terms of Service Agreement ("Agreement") is entered into by and between Arc Eye ("Company") and the user ("User") accessing or using the Company's website, purchasing its products, or utilizing its services.

By accessing Arc Eye's website, purchasing its products, or utilizing its services, the User agrees to be bound by the terms and conditions outlined in this Agreement. If the User does not agree with these terms, they should not use the website, purchase any products, or utilize any services.

Arc Eye sells hardware and software products ("Products") through its website. Descriptions, specifications, and prices of the Products are subject to change without notice.

Arc Eye may provide services ("Services") including but not limited to installation, technical support, and training. The terms and conditions for Services are outlined in separate agreements and may be subject to additional fees.

Users agree to pay the listed price for the Products purchased and the fees for any Services utilized. Payment is processed securely through Arc Eye's designated payment gateway.

Arc Eye will make reasonable efforts to deliver the Products in a timely manner. However, delivery times may vary and are not guaranteed. The risk of loss and title for Products pass to the User upon delivery.

Returns are governed by our Return Policy, available on our website, which forms part of this Agreement.

a. Hardware Warranty: Arc Eye warrants that its WOLF Products will be free from defects in materials and workmanship under normal use for a period of 3 years from the date of purchase. The warranty does not cover damage caused by misuse, accidents, or unauthorized modifications.

b. Software Warranty: Arc Eye warrants that its software Products will perform substantially in accordance with the accompanying documentation. The warranty does not cover compatibility issues, user error, or third-party software conflicts.

a. Hardware: In no event shall Arc Eye be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the hardware Products, including but not limited to loss of data, loss of revenue, or loss of profits.

b. Software: Arc Eye shall not be liable for any damages arising from the use of its software Products, including but not limited to software errors, data loss, or system downtime.

c. Services: Arc Eye shall not be liable for any damages arising from the provision or utilization of its Services, including but not limited to service interruptions, data loss, or delays.

d. Cap: To the fullest extent permitted by law, Arc Eye's total liability for any claim arising out of or relating to the Products, Services, or this Agreement will not exceed the amount you paid for the Product or Service giving rise to the claim.

The User agrees to indemnify and hold harmless Arc Eye from any claims, damages, or losses arising from the User's use of the Products or Services in violation of this Agreement or applicable laws.

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, USA, without regard to conflict-of-law rules. Any disputes arising under this Agreement shall be resolved through binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association. You waive the right to a jury trial and to participate in a class action.

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

This Agreement, together with the Return Policy and any applicable software End User License Agreements (for Arc Eye Studio and Leash), constitutes the entire agreement between you and Arc Eye regarding its subject matter and supersedes all prior agreements, proposals, or representations, whether written or oral.

Arc Eye reserves the right to update or modify this Agreement at any time without prior notice. Users are responsible for regularly reviewing the terms. Continued use of the website, Products, or Services after changes constitute acceptance of the updated terms.

Arc Eye Studio and Leash are licensed under their own End User License Agreements, which govern use of that software in addition to these terms.
